The petitioner seeks regular bail in a case registered under Section 302 and other sections of the Indian Penal Code, Section 27 of the Arms Act and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The informant Jagat Paswan named as many as 31 persons and alleged that they all made indiscriminate firing. The informant further alleged that Yodha Rai and Matar Rai fired which hit on the chest of his son Alha Paswan and Alha Paswan died. It is submitted that of course, the petitioner is named in the F.I.R., but no overt act is alleged against the petitioner. Similarly situated co-accused Kamlesh Misra, Ram Singer Rai, Siyaram Sah, Shambhu Rai, Harendra Singh and others have already been granted bail.
