JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-07-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Pachrukhi P.S. Case No. 94 of 2021, registered for the offences punishable under Sections 363, 366 (A), 34 of the Indian Penal Code. As per allegation, seven accused persons named in the FIR kidnapped the minor daughter of the informant with an intent to solemnize marriage with co-accused Kuldeep Yadav. Learned counsel for the petitioners has submitted that the entire family members of Kuldeep Yadav have falsely been

He has further submitted that after filing of this anticipatory bail petition the victim was recovered and her statement was recorded under Section 164 of the Cr.P.C. in which she did not support the occurrence. The doctor has opined her age as 20-22 years. The learned counsel has submitted further that considering these facts the learned Additional District & Sessions Judge-VIIIth, Siwan has granted anticipatory bail to three accused persons namely, Tarkeshwar Yadav, Shailesh Yadav and Naresh Yadav vide order dated 13.04.2022 in ABA No 722 of 2022.

Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., VI, Siwan in connection with Pachrukhi P.S. Case No. 94 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
