The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 30(a) and (c) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 25 litres of liquor was recovered from a vehicle of which the petitioner was the driver. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 11.4.2022 giving liberty to the petitioner to renew his prayer for bail after four months. The petitioner is in custody since 21.7.2021.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.48128 of 2022(2) dt.28-09-2022 2/2 taking into consideration the allegation in the FIR, liberty granted to the petitioner in the earlier order of rejection dated 11.4.2022 and the petitioner having remained in custody for more than one year, the petitioner is directed to be enlarged on bail in connection with Buxar (Industrial) P.S. Case no. 130 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II - cum - Special Judge, Excise, Buxar.
