2. The petitioner has preferred this application for grant of regular bail in connection with Bihar P.S. Case No. 279 of 2025 dated 08.05.2025 registered for the offences punishable u/ss 137(2) and 96 of the B.N.S. and Sections 4 and 6 of the POCSO Act.
3. As per the prosecution case, the informant's daughter used to go for tuition to Hindustan English Point near Vandana Cinema but on 08.05.2025, the informant's daughter did not return from tuition. Thereafter, the informant tried to search her but she could not be traced out. The informant alleged that the petitioner used to call his daughter from the
Patna High Court CR. MISC. No.47041 of 2025(2) dt.13-08-2025 2/3 mobile number 7481048174 and he apprehends that the petitioner took her daughter on the pretext of marriage.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There was love affair between the victim and the petitioner. Learned counsel has further submitted that the victim in her statement recorded u/s 180 of the B.N.S.S. has stated that she reached the Patna railway junction where she met with the petitioner and went to Gaziyabad with the petitioner without informing anyone. It is further submitted that the victim has not raised any alarm while travelling from Patna to Gaziabad. Learned counsel has further submitted that there is nothing on record which shows that the victim was forced or seduced to have illicit intercourse with another person. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.47041 of 2025(2) dt.13-08-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Nalanda in connection with Bihar P.S. Case No. 279 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
