JUSTICE SATYAVRAT VERMA ORAL ORDER 07-03-2022 Heard learned counsel for the petitioner and Mr. Prem Kumar Jha, learned A.P.P. for the State. The petitioner seeks bail in connection with Kawakol (Rupau) P.S. Case No. 129 of 2021 instituted for the offences under Sections 395 and 412 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 11.05.2021 charge-sheet has been submitted and has antecedent of one case and allegation is of looting motorcycle and mobile of informant by four unknown criminals.

Learned counsel for the petitioner submits that the First Information Report was against unknown and the petitioner was arrested based on suspicion and was made to confess his crime about his participation in the present

Patna High Court CR. MISC. No.58204 of 2021(2) dt.07-03-2022 2/2 occurrence. It is submitted that no incriminating article was recovered from the petitioner nor he was put on T.I. Parade and was made an accused merely based on his confessional statement.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 11.05.2021, charge sheet has been submitted and his name transpired based on his own confessional statement, and there was no recovery nor he was put on T.I. Parade, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IV, Nawada in connection with Kawakol (Rupau) P.S. Case No. 129 of 2021.

Learned counsel for the petitioner is permitted to make rectification in the pleading made in paragraph-1 and prayer portion of the bail application.
