Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Amas P.S. Case No. 171 of 2021, lodged under Section 30(a) of Bihar Prohibition & Excise Amendment Act, 2018. As per the prosecution case, the total recovery of 42 liters of country made wine has been made from the possession of petitioner.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 13.07.2021 and charge sheet has already been filed in this case. On the point of

No.58217 of 2021(6) dt.27-09-2022 2/2 criminal antecedent, learned counsel for the petitioner submits that there is one criminal case pending against the petitioner, in which he is on bail and he assures that in future petitioner will not involve in any such type of activities.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Iind-CumSpecial Judge of Excise Act, Gaya in connection with Amas P.S. Case No. 171 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
