The petitioner apprehends his arrest in connection with Muffasil P.S. Case No.59 of 2017, registered under Sections 341, 323, 307, 380 and 376/511 of the Indian Penal Code. Allegation in brief is that while the informant was sleeping in the night with her husband and children, petitioner made an attempt of rape.
Learned counsel for the petitioner submits that the mother of the petitioner four days prior to the alleged occurrence had lodged a police case against the husband of the informant, therefore, this false case was lodged that the petitioner made an attempt of rape in absence of her husband and this petitioner has
Patna High Court Cr.Misc. No.52832 of 2017 (2) dt.09-11-2017 2 /2 got no criminal antecedent.
Having considered the said facts and circumstances, let petitioner, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Muffasil P.S. Case No.59 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
