Heard Ms. Bela Singh, the learned Advocate for the petitioner and the learned APP for the State. 2.

The petitioner seeks bail in connection with Sessions Trial No. 274 of 2018, arising out of Hajipur Sadar P.S. Case No. 595 of 2017, dated 27.11.2017 (G.R. No. 5302 of 2017) registered for the offences punishable under Sections 4/5 of the Explosive Substance Act, 1908.

The petitioner was granted bail in Hajipur Sadar P.S. Case No. 595 of 2017, dated 27.11.2017 (G.R. No. 5302 of 2017) which was instituted for the offence under Section 4/5 of the Explosive

Patna High Court CR. MISC. No.49820 of 2023(2) dt.10-11-2023 2/3 Substance Act, 1908, vide order dated 17.05.2018 passed in Cr. Misc. No. 24970 of 2018.

Because of the misuse of bail, the bail bonds of the petitioner was cancelled on 16.05.2019. In the meantime, the petitioner was arrested in connection with another case and that perhaps is the reason for no pairvi in this case.

The petitioner appears to have been arrested in this case against the NBW issued against him on 14.03.2023. He is in custody since then.

Regard being had to the fact and circumstances of the case, especially the period that he has remained in jail after he was taken in custody again on 14.03.2023, the petitioner is directed to be released on bail on his furnishing bond in the sum of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- XII, Vaishali at Hajipur, in connection with Sessions Trial No. 274 of 2018,
