The petitioner seeks pre-arrest bail in connection with Bhabua P.S. Case No. 630 of 2017 registered under Sections 420, 467, 468 and 471 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the petitioner had purchased the land in question after paying the entire consideration money to the vendor of the land namely, Beena Agrwal who had provided the rent receipt, land possession certificate and order of partition suit, etc. and by no stretch of imagination, the ingredients of the offences alleged
Patna High Court Cr.Misc. No.61003 of 2017 (2) dt.21-12-2017 in the FIR can be attributed against the petitioner. In support of his submission, he has relied upon the decision of the Supreme court in cases of Md. Ibrahim & Ors. Vs. State of Bihar & Anr.[(2009) 8 SCC 751] and Devendra and Ors. Vs. State of U.P. and Anr.[(2009) 7 SCC 495].
Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. Regard being had to the nature of allegation and submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 630 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
