JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners were earlier on bail but they failed to appear before the trial court on 10.02.2016 when a prosecution witness came for deposition. Moreover, it appears that a representation petition under Section 317 (2) of the Cr.P.C. had been filed on behalf of the petitioners on 10.02.2016 but when the case was called out, no one appeared to press the aforesaid petition resulting rejection of the aforesaid petition. Moreover, it appears that petitioners voluntarily surrendered before the court below on 18.02.2016 and since then they are languishing in jail custody. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand)

Patna High Court Cr.Misc. No.10456 of 2016 (2) dt.04-03-2016 2/2 each with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Gopalganj in connection with Bhorey P.S. Case No. 89 of 2012 corresponding to Trial No. 116 of 2012.
