Petitioner seeks bail in Kotwali (Barari) P.S.Case No.280 of 2014 registered under Sections 20,22 and 25 of N.D.P.S. Act The petitioner along with another was apprehended and from their possession, 10 bundles Ganaj was recovered, on weighing, it comes to 136 kgs.

It is submitted that the petitioner is the driver of the vehicle. The owner of the vehicle was also arrested. The petitioner had no knowledge about Ganja kept in the vehicle. Having considered the fact that the petitioner, the driver of the vehicle and the owner of the vehicle were carrying huge quantity of Ganja being 136 Kgs., I am not inclined to enlarge he petitioner on bail and accordingly, the same is rejected.

The Superintendent of Police, Bhagalpur is directed to make efforts for production of the prosecution witnesses for evidence on the date fixed in the court, so that the trial may conclude within the time frame.
