JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report but he has been made accused in this case on the ground that in course of investigation, it came to light that the motorcycle, which had been used in committing the alleged crime, belonged to petitioner and except the aforesaid material, there appears to be nothing against him. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 10.11.2015.

Considering the aforesaid facts and circumstances as

No.10695 of 2016 (2) dt.08-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Barahiya P.S. Case No. 223 of 2015.
