JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 09.07.2014 in a case registered for the offences punishable under section 302/34 Of the Indian Penal Code.

The prosecution case is that petitioner along with four other accused persons came on two motor cycles and surrounded the husband of informant when first shot was fired by co-accused Raj Deo while other shot was fired by co-accused Raj Nath Singh leading to the death of husband of informant. It is submitted by learned counsel for the petitioner that allegation of firing is not against this petitioner and during post mortem examination only two injuries have been found on the deceased. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Bheldi P.
