Mr.A.PP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 25-04-2022 Heard learned counsel for the petitioners and learned APP for the State.

The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Bikramganj P.S. Case no. 132 of 2021 instituted for the offence punishable under Sections 341, 323, 147, 148, 307, 325, 506, 504 and 34 of the Indian Penal Code.

As per allegation in the FIR, when the informant was at his home, all the accused persons including the petitioner entered into his house and started to assault him and his son by means of iron rod and danda resulting into left wrist fracture of the informant and head injury to his son.

Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. There is case and counter case. Both parties have sustained

Patna High Court CR. MISC. No.57438 of 2021(3) dt.25-04-2022 2/2 injuries. Father and mama of the petitioner have also sustained grievous injury. Petitioner no. 1 is student of engineering college and petitioner no. 2 is student of Marine engineering. They have got no criminal antecedent. Several accused persons have already been granted anticipatory bail by this court vide order no. 6.4.2022 passed in Cr. Misc. No. 52269 of 2021.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Bikramganj P.S. Case no. 132 of 2021, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I. Bikaramganj Rohtas subject to the conditions as laid down under section 438(2) of the Cr.P.C.
