In the background of dispute relating to homestead land, it has been alleged by the informant that on 21.12.2014 at about 06:00 PM these petitioners including Babloo Manjhi armed with Lathi and Pati of cot came and began to assault him. His wife Anita Devi, brother Guddu Manjhi and mother Chinta Devi came in rescue who were also assaulted. Guddu and Chinta were forwarded to PMCH and during course of treatment Guddu died.
Gone through the case diary. There happens to be omnibus allegation against all the three petitioners including Babloo to have inflicted blows upon the respective injured/ deceased. So far nature of injuries are concerned, deceased
Patna High Court Cr.Misc. No.17585 of 2015 (3) dt.25-06-2015 Guddu had sustained single injury, lacerated wound on the tempo parietal region over left side of scalp 3" x 1⁄2", Anita Kumari wife of informant, bruise 2" x 1⁄4" over left parietal region caused by hard and blunt substance simple in nature, informant Naresh Manjhi bruise over forearm 11⁄2" x 1⁄2" x 1", lacerated wound over left side of scalp 1" x 1" simple in nature. No injury report of Chinta Devi is available nor Chinta Devi in her statement recorded under para-21 of the case diary had claimed likely so.
Taking into account the statement of witnesses inconsonance with the injury sustained by respective injured as well as deceased, petitioners Petu Manjhi, Ledu Manjhi, Anil Manjhi each are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with MMCH P.S. Case No.183 of 2014.
