The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and 27 of the Arms Act.

The petitioner along with other co-accused are alleged to have shot fire causing the death of the deceased. It is submitted that similarly situated co-accused has been granted bail.

From perusal of the record, it appears that the petitioner, who is one of the assailants of the deceased, is alleged to have fired and altogether there are six firearm injuries on the person of the deceased.

Patna High Court Cr.Misc. No.15647 of 2015 (4) dt.03-09-2015 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. His prayer for bail is rejected. However, the trial Court is directed to expedite the trial and hold the same on day to day basis. If the trial is not concluded within a period of one year, the petitioner may renew his prayer for bail.
