The petitioner apprehends his arrest in Digha P.S. case No. 283 of 2017 for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act.
The informant alleged that the officials of Housing Board were measuring the lands situated in Digha but the residents became violent. They came, having armed with different weapons, and assaulted the police officials.
The learned counsel for the petitioner submits that petitioner and others have purchased the land and they are residing after constructing their houses. The police officials along with officials of Housing Board came to demolish the house of
Patna High Court Cr.Misc. No.63604 of 2017 (2) dt.11-01-2018 2/2 petitioner and others for that the residents of Digha made peaceful protest.
Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that similarly situated accused have already been granted anticipatory bail, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Patna in connection with Digha P.S. case No. 283 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
