ANJANA MISHRA ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Dhankund P.S. Case No.36 of 2019 for allegedly having committed the offence under Sections 379, 411, 420, 467, 468 of the Indian Penal Code and Section 4 of the Bihar Mineral Prevention of Illegal Mining Transportation and Storage BMMC Rules, 2003, Amendment Act, 2014 and Section 40 of the Forest and Environment Act. Learned counsel for the petitioner submits that the petitioner is the owner of the tractor, bearing registration No.BR51G 0866. Learned counsel submits that the driver of the vehicle was carrying sand without Challan. It is further submitted that the driver plied his tractor on daily basis and it

It is further submitted that the loss incurred has been deposited by the petitioner by means of Bank draft and as such, he may be extended the privilege of anticipatory bail.
Considering the entire facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in connection with Dhankund P.S.
