2. Heard learned counsel for the petitioner and learned APP for the State.
3. In the present case, the petitioner seeks bail in connection with Sheikhpura Mahila P.S. Case No. 10 of 2025 registered for the alleged offences under Sections 126(2), 117(1), 76, 79, 110, 74, 352, 296 of the Indian Penal Code and Sections 4/8/11 of POCSO Act.
4. As per prosecution case, the petitioner was in habit of teasing the girls and on the date of occurrence, he snatched the scarf of the minor daughter of the informant. He also used
Patna High Court CR. MISC. No.47729 of 2025(3) dt.15-10-2025 2/3 filthy language with the minor girl. When the minor girl went to make complaint to the father of the petitioner, he and his family members brutally assaulted the girl and disrobed her.
5. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The allegations are malicious and fabricated. In the month of January, mobile phone of one Uzair Khan was stolen by the daughter of the informant for which a panchayati was held and the mobile phone was recovered from the possession of the daughter of the informant. As the petitioner attended the panchayati, due to this grudge, the petitioner has been falsely implicated in this case. The informant has exaggerated the small incident for making the case graver. Learned counsel further submits that now the matter has been compromised between the parties and a petition to that effect has been filed before the learned trial court mentioning this fact. The petitioner is having clean antecedent. The petitioner is in custody since 06.06.2025 and charge sheet has been submitted.
6. Learned APP opposes the submission made on behalf of the petitioner.
7. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the
Patna High Court CR. MISC. No.47729 of 2025(3) dt.15-10-2025 3/3 nature of allegation, period of custody of the petitioner, his clean antecedent and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge -cum- Special Judge (POCSO Act), Sheikhpura/concerned Court in connection with Sheikhpura Mahila P.S. Case No. 10 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
