The petitioners apprehend their arrest in connection with Benipatti P.S. Case No. 134/2019 registered for the offences punishable under Sections 341//323/324/325/307/ 354(B)/379/504/506/34 of the Indian Penal Code. The petitioners are said to have assaulted the injured by fists on his mouth which has caused serious injury and the petitioners are trying to argue that the injury may be simple and Section 307 of the I.P.C. is not made out in this case. Since, there is specific allegation against Sudhir Bhandari (petitioner No. 1) that he has assaulted on the mouth of injured which has caused serious injury, his prayer for grant

Patna High Court CR. MISC. No.4316 of 2021(2) dt.23-11-2021 2/2 of anticipatory bail is rejected.

So far as petitioner No. 2 is concerned who is a lady therefore, she is granted anticipatory bail.

Let the petitioner No. 2 (Kusama Devi) above named be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, Madhubani, in connection with Benipatti P.S. Case No. 134/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
