JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-01-2018 Heard Mr. Vinod Kumar, learned counsel for the petitioner and Mr. Vinay Kriti Singh, learned counsel appearing for the South Bihar Power Distribution Company Limited. The petitioner seeks pre-arrest bail in connection with Bodh Gaya (Cherki) P.S. Case No.364 of 2017 registered under Sections 406 and 420 of the Indian Penal Code. Regard being had to the alleged defalcation of Rs.1,11,722/- (rupees one lac eleven thousand seven hundred twenty two) which the petitioner collected as franchisee appointed by the South Bihar Power Distribution Company Limited and failed to deposit the same in the account of the South Bihar Power
Patna High Court Cr.Misc. No.1295 of 2018 (2) dt.19-01-2018 2/2 Distribution Company Limited, I am not inclined to grant him prearrest bail. Accordingly, the application for grant of pre-arrest bail of the petitioner is rejected.
In case the petitioner surrenders and prays for bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
