Petitioners apprehend their arrest in Shambhuganj P.S. Case No.301 of 2018, registered under Section 307 and other sections of the Indian Penal Code.
The informant named 16 accused persons in the FIR and alleged that they all assaulted the informant and his family members.
Patna High Court CR. MISC. No.44846 of 2019(2) dt.22-07-2019 2/2 Learned counsel for the petitioners submits that no specific allegation is made against the petitioners. There is counter version being Shambhuganj P.S. Case No.300 of 2018. Rajesh Paswan and seven others have already been granted regular bail by this Court. Simple injuries are found on the persons of the injured.
Taking into consideration the facts that there is a case and counter case and both sides appears to have entered into mutual assault on each other in which the injuries sustained by the informant and others are simple in nature, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Banka in connection with Shambhuganj P.S. Case No.301 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.KUMAR/- U T
