The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Rampur P.S. Case no. 192 of 2015 instituted for the offence punishable under Sections 414/34 of the Indian Penal Code. As per allegation in the FIR, two stolen motorcycles i.e. Hero Honda splendor and Hero Honda glamour were recovered from the house of the petitioners.
Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have got no criminal antecedent. They have
Patna High Court CR. MISC. No.58638 of 2021(5) dt.21-09-2022 2/2 been falsely implicated in this case merely on the basis of suspicion. Nothing has been recovered from conscious possession of the petitioners.
Learned APP appearing for the State has opposed the prayer of Bail and submitted that two stolen motorcycles were recovered from the house of the petitioners and they could not produce any valid documents regarding ownership of the vehicles.
Having heard learned counsel for the parties and taking into consideration that there is recovery of stolen articles from the house of the petitioners, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected. (Sunil Kumar Panwar, J) sushma/- U
