JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-07-2019 This is an application for grant of anticipatory bail in connection with Chanpatiya (Sirisiya O.P.) P.S. Case No. 525 of 2018, disclosing offences under Sections 420, 467, 468 and 469 of IPC.
Written report of the informant disclosed that his father has purchased 09 Kathas 08 Dhurs of land from the petitioner, vide sale deed dated 17.11.2018 and they are in possession over the land. Thereafter, the petitioner has executed a sale deed in favour of one Vinod Mishra, vide sale deed dated 15.12.2018 and the informant is being threatened by others. Submission of the learned counsel for the petitioner is that he is aged about 80 years and Annexure 2 is the death certificate of his wife, which shows that his wife died on 17.11.2018 and as such, it does not appear believable that he

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub- Divisional Judicial Magistrate, Bettiah, West Champaran, in connection with Chanpatiya (Sirisiya O.P.) P.S. Case No. 525 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
