Petitioner is apprehending his arrest in connection with Rivilganj P.S.Case No.335 of 2018 , registered for offences punishable under Sections 302/120(B)/34 of the Indian Penal Code.

As per the FIR, petitioner and other accused persons have assaulted the deceased causing his death. Submission of the learned counsel for the petitioner is that they have falsely been implicated in this case and there is no eye witness of the occurrence and another co-accused person having similar allegation has been grated privilege of the anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 18.6.2019 passed in Cr. Misc. No.12798 of 2019.

Patna High Court CR. MISC. No.45099 of 2019(4) dt.05-11-2019 2/2 Heard learned A.P.P. who has opposed the prayer for bail on the ground that the petitioner is named in the FIR and there is allegation against him also. .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of three weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VIII, Saran at Chapra in connection with Rivilganj P.S.Case No335 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
