In this case the petitioners seek regular bail in connection with Dumariya P.S. Case No. 62 of 2012 registered for offence punishable under Sections 147, 148, 149, 341, 323, 324,
Patna High Court Cr.Misc. No.20583 of 2015 (3) dt.29-07-2015 2/3 307, 302,435,332,353,333,120B of the Indian Penal Code, 27 of the Arms Act, 3/4/5 of the Explosive Substance Act, 10/11/13(i), 13(ii) of U.P.A Act and 17 of the C.L.A Act. It has been submitted that the petitioner Chanarik Ravidas @ Pachu @ ChandanJi @ Chanarik Das is in custody since 09.01.2014 and petitioner Chotu Das is in custody since 11.03.2014. A coordinate Bench of this Hon'ble Court in Cr. Misc. No. 44813 of 2013 vide order dated 11.11.2013 has granted bail to the similar accused person namely, Deepak Kumar @ Deepak Jee, whose name finds place at Serial no. 31 of the names of accused in the first information report.
Under such circumstances, let the petitioners named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Court, Gaya in Dumariya P.S. Case No. 62 of 2012, Tr. No. 33 of 2015 with following conditions :- i) One of the bailors will be the close relative of the petitioners.
ii) The petitioners will not indulge in similar or in any other offence.
iii) The petitioners will be well represented in the
Patna High Court Cr.Misc. No.20583 of 2015 (3) dt.29-07-2015 3/3 Court.
iv) In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the Court concerned.
