2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 3/4/5/6 of the Immoral Traffic (Prevention) Act, 1956 pending in the learned court below.

3. As per the prosecution case, petitioner along with other co-accused person is involved in the illegal business of prostitution.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner is the owner of the hotel where the raid were happened. He submits that petitioner being owner of the hotel is not concerned with the day to day affairs of the hotel rather a Manger in the hotel is entrusted for

He further submits that as per the norms, the rooms are booked only after getting the Adhaar Card of the concerned persons for booking the room in the hotel. He further submits that petitioner has got no criminal antecedent as stated in para-3 of the bail application.

5. Per contra, learned APP for the State vehemently opposing the bail application and submits that apprehended person given statement before the Police that they have come into business of prostitution for the first time. Hence, he does not deserve anticipatory bail.

6. Considering the facts and circumstances of the case and the fact that petitioner along with manager of the hotel is involved in this case, I am not inclined to enlarge the petitioner on bail in connection with Sheikhpura P.S. Case No. 379/2023. Accordingly, his prayer for anticipatory bail is hereby rejected. (Anjani Kumar Sharan, J) ajay/- U T
