JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Sessions Trial No.32 of 2014 arising out of Adhaura P.S. Case No.30 of 2013 registered for the offence punishable under section 306 of the Indian Penal Code.

The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 23.1.2014 passed in Cr. Misc. No.2994 of 2014 with following observations:- "The Chief Judicial Magistrate, Kaimur at Bhabua, before whom the matter is pending, is directed to commit Adhaura P.S. Case No.30 of 2013 to the court of sessions forthwith. If the trial is not concluded within one year from the

Patna High Court Cr.Misc. No.18704 of 2015 (2) dt.29-04-2015 2/2 date of receipt/production of a copy of this order in the court below, the petitioner would be at liberty to renew his prayer for bail."

It has been contended that till date no witness has been examined on behalf of the prosecution.

Regard being had to the observations made in the aforementioned order dated 23.1.2014 passed in Cr. Misc. No.2994 of 2014, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge,-VI, Kaimur at Bhabua in connection with Adhaura P.S. Case No.30 of 2013 (Sessions Trial No.32 of 2014).
