The petitioner seeks bail in a case for the offence punishable under Section 364A/34 of the Indian Penal Code.

F.I.R. was lodged against unknown. During investigation the name of the petitioner has appeared as one of the accused.

It is submitted by the learned counsel for the petitioner that during investigation the victim boy (Suman Kumar Bhagat) has made statement at para-21 in which no allegation has been made against the petitioner. The petitioner has no criminal antecedent.

However, after investigation chargesheet has already been submitted. Charge has also been framed but up-till-now no witness has been examined. Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/-

Patna High Court Cr.Misc. No.5737 of 2015 (4) dt.21-04-2015 2/2 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Adhoc A.D.J.-Ist, Bhagalpur in S. T. no. 99 of 2013 arising out of Kahalgaon P.S. Case no. 309 of 2013 with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) sudip/- U T
