The petitioner seeks bail in anticipation of her arrest in connection with Tetarhat P.S. Case No. 02 of 2020, dated 08.01.2020, instituted for the offences under Sections 366(A), 504 and 506/34 of the Indian Penal Code. The allegation against the petitioner and others is
Patna High Court CR. MISC. No.2810 of 2021(2) dt.23-07-2021 2/3 of abducting the minor daughter of the informant for getting her married to one Rishideo Kumar @ Rishodeo Manjhi. It has been submitted on behalf of the petitioner that the entire prosecution story is false and concocted. The occurrence took place on 02.01.2020, but the F.I.R. has been lodged on 08.02.2020. It has further been submitted that the victim is a major and she has, of her own volition, married one Rishideo Kumar @ Rishodeo Manjhi. An affidavit also has been sworn by her that she has married the accused/Rishideo Kumar @ Rishodeo Manjhi of her own choice. The victim, it has been urged, is not a minor but a major.
Regard being had to the facts afore-stated and that two of the other accused persons of this case have been granted anticipatory bail by this Court, the petitioner abovenamed, in the event of her arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.2810 of 2021(2) dt.23-07-2021 3/3 learned Chief Judicial Magistrate, Lakhisarai in connection with Tetarhat P.S. Case No. 02 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
