The petitioner seeks bail in connection with Gopalpur P. S. Case No.52 of 2021, instituted for the offences under Sections 304(B), 201/ 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 20.04.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that his daughter was married Dhurendra Giri, son of the petitioner about 04 years back and the accused persons three years after the marriage started demanding Rs. Two lacs by way of dowry. Further on account

Patna High Court CR. MISC. No.58346 of 2021(2) dt.07-03-2022 2/3 of non-fulfilment of the demand, the accused persons started torturing his daughter. It is alleged that when he came to know that his daughter was killed, accordingly, the informant went to the place of occurrence, but the petitioner was not able to find the dead body of the deceased.

The learned counsel for the petitioner submits that the petitioner is the father-in-law and he is separate in mess and property from Dhurendra Giri. The responsibility, if any, to keep his wife with honour and dignity lies with Dhurendra Giri. The learned counsel for the petitioner further submits that the younger sister of the deceased is married to the younger son of this petitioner Nagendra Giri. It is thus submitted that it absolutely does not stand to reason that when daughters from same family have been married in the family of the petitioner then the family of the petitioner would be demanding dowry from one of the daughters and this fact has been concealed in the F.I.R.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of

Patna High Court CR. MISC. No.58346 of 2021(2) dt.07-03-2022 3/3 Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Bettiah, West Champaran in connection with Gopalpur P. S. Case No.52 of 2021.
