The petitioner seeks bail in a case instituted for the offences under Sections 467, 468 and 471 of the Indian Penal Code.
As per the First Information Report the police on the basis of the information about illegal business of Sim card and voter identity card of Election Commission of India has raided the shop and from where seven voter I.D. card issued by the Election Commission of India as well as several documents has been recovered.
Learned counsel for the petitioner submits that petitioner is not involved in the alleged offence merely he is
Patna High Court Cr.Misc. No.19114 of 2015 (2) dt.15-06-2015 partner of the firm and other accused persons have already been granted bail by this Court.
Having considered the facts and circumstances of the case, let petitioner, Arun Kumar, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Jehanabad in Karpi P.S. Case No. 37 of 2015, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner (ii) If the petitioner is found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (iii) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
