JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The deceased was engaged by the petitioner to drive his tempo and on 01.03.2015 deceased left his home to go to the house of petitioner but since then deceased was found missing. On 02.03.2015, informant went to the house of petitioner in search of his son, then petitioner disclosed that deceased was missing with his tempo. Subsequently, on 07.03.2015 a dead body was recovered from maize field and the informant identified the aforesaid dead body on the basis of photographs. The petitioner was arrested on suspicion but claim of the petitioner is that deceased fled away with his tempo for which petitioner filed Complaint Case bearing Complaint Case No.776 of 2015 on

Patna High Court Cr.Misc. No.11187 of 2016 (2) dt.10-03-2016 2/2 18.03.2015, Moreover, none has seen the actual killing of the deceased.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub-Judge I cum Additional Chief Judicial Magistrate, Purnea in connection with Sadar Muffasil P.S.Case No. 93 of 2015.
