2. Petitioner seeks bail in connection with a case registered for the offence under Sections 310(4) & 310(5) of the BNS and Sections 25(1-b)a, 26/35 of the Arms Act.

3. As per the prosecution case, on a secret informant that some miscreants have assembled to commit crime, raid was conducted in the semi constructed house of the co-accused Arjun Yadav where three other co-accused were arrested on the spot. On search, arms and ammunition were recovered from the possession of some co-accused persons, while petitioner managed to escape.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused. There is no independent witness of the alleged search and seizure. Petitioner is in custody since 29.4.2025. Similarly situated co-accused has already been

Patna High Court CR. MISC. No.46915 of 2025(3) dt.19-12-2025 2/2 allowed bail by this Court vide order passed in Cr.Mis.No. 15584/2025. Chargesheet has been submitted.

5. Considering the facts and circumstances of the case and also the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, IV, Begusarai/ concerned court in connection with Sahebpur Kamal P.S.
