The petitioners are apprehending arrest in a case registered for the offences punishable under sections 419,420,409,467,468,471 and 120B of the IPC.
The prosecution case is that the petitioner on the basis of forged TET certificate, got appointed as Panchayat Teacher.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.61923 of 2017(2) dt.22-12-2017 2/3 that the petitioner was appointed after due verification and now the petitioner has been removed from service, though statement to that effect has not been made in the petition. It is further submitted that similarly situated persons accused in different FIR have been granted bail by co-ordinate benches of this Court vide orders dated 1.9.2017 and 21.9.2017 passed in Cr. Misc. Nos. 40091 and 43031 of 2017 respectively, as contained in Annexure 2 and 3 series.
Considering the fact that similarly situated accused in different FIRs, have been granted anticipatory bail, the petitioners have been removed from service coupled with the statement in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM - VIII, Saran at Chapra in connection with Mashrakh P.S. Case No. 260 of 2017.
The learned court below will be at liberty to cancel the bail bonds of the petitioners in case they fail to cooperate in
Patna High Court Cr.Misc. No.61923 of 2017(2) dt.22-12-2017 3/3 the investigation.
