The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468 and 120(B)/34 of the Indian Penal Code. It is alleged that the petitioner in the capacity of the then Panchayat Secretary made appointment of Shikchha Mitra in the year 2003 which was found illegal by the BEO, Supaul. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner was the then Panchayat Secretary and he was authorized only to forward the applications and it is the Mukhiya who conducts the Aam Sabha and makes appointment of Shikha Mitra. Patna High Court CR. MISC. No.58399 of 2021(2) dt.21-06-2022 2/2 submits that similarly situated co-accused has already been granted anticipatory bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 52854 of 2017.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Supaul in connection with Supaul P.S.
