1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 352, 76, 303(2), 190, 191(2) and 191(3) of the BNS.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on account of dispute relating to land, accused Bholi Ram (petitioner no. 1) assaulted him by Bhala causing injury on back side of the head while Vikram Ram (petitioner no. 2)
Patna High Court CR. MISC. No.47554 of 2025(2) dt.30-07-2025 2/3 assaulted by Gandasa causing injury on his ears thereafter Surendra Ram (petitioner no. 3) assaulted by rod on his leg and back. Further, Surendra also snatched the Mangalsutra of the wife of the informant and torn her Saree and blouse. Thereafter, Dharmendra Ram (petitioner no. 4) assaulted the son of the informant Raushan by rod causing injury on head while Gallu Kumar assaulted Vishal by lathi causing injury on head. Further, Manoj Ram assaulted Rakesh Kumar by Gandasa causing injury on finger.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that it does not appear probable that petitioners with such certainty could have alleged who assaulted whom by what and where. It is next submitted that from perusal of the order impugned, it would manifest that the injury suffered by the injured has been opined to be simple caused by hard blunt substance. It is also submitted that on account of dispute relating to land an altercation took place in which both sides assaulted each other and from the side of the petitioners also people suffered injury. It is submitted that petitioners are not the criminals and petitioner no. 1 is aged about 75 years.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Bathwariya P.S. Case No. 18 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS. (Satyavrat Verma, J) Kundan/- U T
