The petitioner seeks bail in connection with Nautan (Jagdishpur) P. S. Case No.516 of 2020, instituted for the offences under Sections 457 and 380 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 27.12.2020, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that a theft of 40 mobiles and 40 keypad was committed by unknown criminals from his shop. The learned counsel for the petitioner submits that the F.I.R. was against unknown and the petitioner came to be

Patna High Court CR. MISC. No.58327 of 2021(2) dt.07-03-2022 2/2 implicated as he was having dispute with the informant and it was falsely alleged that 10 mobiles were recovered from his possession.

The learned counsel further submits that even assuming what has been alleged is true without admitting the same then this is the first offence of the petitioner. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, West Champaran, Bettiah in connection with Nautan (Jagdishpur) P. S. Case No.516 of 2020. The application stands allowed.
