The petitioner seeks bail in a case registered for the offence punishable under Sections 121, 121 (A), 307, 120(B)/34 of IPC, Sections 3, 4 and 5 of Explosive Substance Act and Sections 16, 17, 18, 19, 20 of Unlawful Activities Protection Act. It is submitted that the name of the petitioner has appeared in the statement of co-accused Adhik Yadav. He is a businessman and his name has appeared in this case due to retaliation. He has also been made accused in Chanan P. S. Case No. 33 of 2013 in which he has already been granted bail by this Court vide Cr. Misc. No. 51504 of 2014. He has been remanded in this case. After investigation charge-sheet has been submitted and
Patna High Court Cr.Misc. No.6225 of 2015 (3) dt.21-04-2015 2/2 there is no chance of tampering with the witnesses. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Shyamal Kumar, learned Judicial Magistrate, 1st Class, Jamui/court concerned in Barhat P. S. Case No. 13 of 2014 after framing of charge with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
