JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 28.01.2016 in a case registered under section 379 of the Indian Penal Code on the accusation that stolen motorcycle of the present case was recovered from his possession for which Kotwali ( Tilkamanjhi) P.S.Case No. 753 of 2015 was registered.
The contention on behalf of the petitioner is that the petitioner has already been granted privilege of bail in Kotwali (Tilkamanjhi) P.S.Case No. 753 of 2015 by this Court and, as a matter of fact, the stolen motorcycle of the present case has not been recovered from possession of the petitioner. Considering the aforesaid facts and circumstances as

No.12012 of 2016 (2) dt.17-03-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P.S.Case No. 336 of 2015.
