JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-12-2017 Heard learned counsels for the petitioners and State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 147, 149, 353, 336, 307, 427 and 120B of the IPC and Sections 3/4 of the Prevention of Damage to Public Property Act.

The prosecution case, as per the written report of the Block Development Officer, Kako is to the effect that during protest being made against non-supply of power, the National Highway No. 83 was blocked and when the administration reached on the spot, the mob pelted stones, damaged the vehicle and thereby caused injury to the police personnel and others. The FIR was registered against 28 named persons including the petitioners

Patna High Court Cr.Misc. No.59670 of 2017(2) dt.12-12-2017 2/2 and 50 unknown persons.

It is submitted by learned counsel for the petitioners that the accusation against the petitioners is omnibus and general. A statement has been made in paragraph no.3 of the petition that the petitioners have no criminal antecedent.

Considering the fact that the accusation against the petitioners is omnibus and general, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Kako P.S. Case No. 156 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
