Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 504 and 385 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3⁄4 of the Explosive Substance Act. Submission is that allegation against the petitioner and co-accused Shekhar Yadav is of commission of assault with iron rod to Shankar Sahni, the son of the informant. Investigation of the case is already complete, but there is no injury report with the case diary. Petitioner is in custody since 12.09.2020.

Considering the period already undergone by the

Patna High Court CR. MISC. No.4845 of 2021(4) dt.04-08-2021 2/2 petitioner and completion of investigation as well as no material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khagaria P.S. Case No. 675 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
