JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and two others took the victim from his house and after that, victim did not return. The informant expressed his suspicion against the petitioner. In course of investigation, petitioner was arrested and made his confessional statement disclosing the manner as well as place where the deceased was killed by the petitioner and his associates. After that, the investigating officer contacted the officer-in-charge of Bariyarpur police station where the dead body of the deceased had already been recovered and for which Bariyapur P.S.Case no. 90 of 2015 had already been registered. The family members of the deceased identified the dead body of the deceased.

No.13923 of 2016 (2) dt.05-04-2016 2/2 Learned counsel for the petitioner submits that coaccused Arjun Kumar, having more or less similar allegation, has already been granted privilege of bail and so far as recovery of dead body of the deceased is concerned, admittedly, the same had already been recovered prior to recording the confessional statement of petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Jamui P.S.Case No. 156 of 2015.
