JUSTICE PRABHAT KUMAR JHA ORAL ORDER 21-04-2015 Heard the parties. The petitioners seek their bail in Naubatpur P.S.Case No.500 of 2014 registered under Sections 302, 201/34 IPC and Section 3(2)(v) of the SC/ST Act.

The informant alleged that his brother had altercation with Bhutta Yadav and Madhuri @ Madhuria on 24.9.2014 and they took his brother for taking wine and killed him. The informant came to know this fact on 27.9.2014 that the dead body of his brother was thrown in a canal. A Panchayati was held. The FIR was lodged 01.10.2014.

It appears that there is no eye witness of the occurrence. The informant himself stated that on 24.9.2014, his brother went along with the petitioners and Bhutta Yadav and his dad body was recovered on 27.9.2014 but the case was lodged on 01.10.2014. Co-accused Bhutta Yadav has already been enlarged on bail by order passed in Cr.Misc.No.12358 of 2015. The case of the petitioners stands on same footing.

No.7661 of 2015 (3) dt.21-04-2015 2/2 Considering the facts aforesaid, the petitioners, named above, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, Patna in connection with Naubatpur P.S.Case No. 500 of 2014.
