The petitioners apprehend their arrest in connection with Complaint Case No. 1440 of 2016 instituted under Sections 406 and 420 of the Indian Penal Code.

It is submitted that the petitioners are neither the Managing Directors nor the Proprietor of the company rather they are employees engaged by the Director of the company like the complainant, who was also an agent and the money was deposited by the investors in the company and the petitioners have no criminal antecedent.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.52833 of 2017 (2) dt.09-11-2017 2/2 circumstances, let the petitioners, namely, Ajay Kumar Thakur and Md. Sazeed Khan, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Rohit Kumar, Judicial Magistrate, 1st Class, Purnea in connection with Complaint Case No. 1440 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
