JUSTICE SATYAVRAT VERMA ORAL ORDER 12-07-2022 The learned counsel for the petitioners at the outset seeks permission to make rectification in the pleadings at Paras7 and 12 of the anticipatory bail application. Permission is accorded.

Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 366(A)/ 34 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioner no.1 has antecedent of one case and petitioner no.2 is a person with clean antecedent and is a woman and the

No.58906 of 2021(2) dt.12-07-2022 2/3 informant alleges that on 31.03.2021, his minor daughter was at her house on the roof when Sonalki Kumar, son of the petitioners called his daughter and took her to some other place. It is next alleged that thereafter, when the wife of the informant tried to search her, then she came to know that the accused persons including the petitioners have enticed her daughter for the purpose of marriage.

The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and they are parents of Sonalki Kumar. It is next submitted that it appears that the victim and Sonalki Kumar were in love and they were eloped on their own sweet-will. It is next submitted that petitioners were completely unaware that any love was brewing between the victim and Sonalki Kumar. It is further submitted that these days, it is in vogue to implicate all the family members, without attributing any specific allegation. It is next submitted that the allegations are also general and omnibus in nature as the informant does not disclose that how his wife came to know that it were the petitioners, who enticed his daughter and made her eloped with their son.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned

No.58906 of 2021(2) dt.12-07-2022 3/3 counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Belchi P. S. Case No.19 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
