JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-09-2022 The present writ petition has been filed seeking the following reliefs:- "(i) For issuance of writ in the appropriate nature commanding and directing the Respondent authorities to issue necessary direction to the Circle Officer and the District Revenue Officer to appoint the Anchal Amin in view of the letter dated 18.02.2022 and 13.04.2022 to complete the measurement of Plot No. 9937 under Khata No. 1604 which has been recorded in the name of the State of Bihar as Gair Mazarua Road to identify the encraochers and further direction to the Respondent authorities to remove the encroachment from the said Road.

Patna High Court CWJC No.12476 of 2022(2) dt.02-09-2022 2/3 (ii) For further direction to the Respondent authorities to complete measurement of Plot No. 9938 under Khata No. 818 and 9947 of Khata No. 473 and 9940 of Khata No. 308 which are recorded in the name of the petitioner and are just adjacent to Plot No. 9937 under Khata No. 1604 for which the petitioner has already deposited the cost of Anchal Amin in the Nazarat.

(iii) For further direction to the Respondent authorities to remove the entire encroachment from the public road i.e. Plot No. 9937 under Khata No. 1604 as the same has been encroached by making pucca construction by many persons of the locality and as such the general public of the village including the petitioner are not in a position to move their vehicles.

(iv) For further holding an inquiry against the Respondent Circle Officer who intentionally get demarcated the land of the petitioner and issued notice for removal of the encroachment though the petitioner has already removed the encroachment. But for the reason best known the Respondent Circle Officer has not demarcated the entire land of Road bearing Plot No. 9937 in the interest of encroachers for oblique motive and take appropriate action against the Respondent concerned."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle

Liberty so sought is granted.

The writ petition stands disposed off.
