JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. At the very outset, it is pointed out by learned counsel for the petitioner that in written report of the informant, the name of petitioner has been mentioned as Raiji Ram at serial no. 2 of the accused column but in formal F.I.R., the name of petitioner has been mentioned as Ramji Ram.

Petitioner seeks bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.

The first information report was lodged against eight persons including the petitioner and it is stated that petitioner and others went near the son of the informant and it was co-accused,

Patna High Court Cr.Misc. No.11239 of 2016 (2) dt.10-03-2016 2/2 Mithilesh Ram @ Mithu Ram, who assaulted the deceased by means of sharp edged weapon. Petitioner happens to be member of unlawful assembly and no specific overt-act has been attributed against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Rupauli P.S. Case No. 178 of 2015.
