The petitioner is languishing in custody since 05.12.2014 in case registered for the offences punishable under sections 311/323/307/34 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that all the accused persons assaulted the informant with fists when this petitioner caused fire arm injury at the right shoulder of the informant. It is submitted by learned counsel for the petitioner that at earlier point of time the brother of the petitioner was assaulted by the informant's side for which P.S. Case was registered. There is no accusation of repeating blow and the
Patna High Court Cr.Misc. No.19400 of 2015 (3) dt.25-06-2015 2/2 investigation has already concluded. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Gogri P.S.
