2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Motipur P.S.Case No. 213 of 2023.
3. As per allegation, co-accused persons including the petitioner surrounded the informant's side and caused head injuries to the injured Jaswant Kumar and Sujit Kumar. Coaccused Arjun Thakur also assaulted the informant with an iron rod, causing head injury to him. Thereafter, the petitioner came to the place of occurrence and fired indiscriminately, causing stampede.

The learned counsel for the petitioner has submitted that the allegation of inflicting assault on the person of the injured is not against the petitioner, rather it is against the other co-accused persons. So far as the present petitioner is concerned, there is allegation of firing shot in the air. None has suffered any kind of fire-arm injury. The petitioner is a person of clean antecedents and is in custody since 23.05.2025.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, West Muzaffarpur in connection with Motipur P.S.Case No. 213 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
